A New York judge, Erin P. Gall, is facing potential removal from her position after a profanity-laced confrontation with police officers and others at a graduation party in July 2022, where she threatened to shoot four Black teens, made comments that cast doubt on her impartiality, and repeatedly invoked her judicial office.
The New York State Commission on Judicial Conduct has determined that Justice Erin P. Gall should be removed from the bench. This decision was made following an investigation into a highly controversial incident that occurred at a graduation party in New Hartford on July 1-2, 2022.
The incident in question involved a graduation party attended by Gall, her husband, and her three children, including her 18-year-old son. The party, which started with approximately 60 invited guests, escalated as more people learned about it through social media. A fight broke out after 11:30 PM, involving Gall’s husband and son, as well as several minors.
When police responded to the scene, Gall engaged in a “loud, public, prolonged and profanity-laced confrontation” with the officers. She repeatedly invoked her position as a state Supreme Court judge, mentioning it more than a dozen times over an hour and 20 minutes.
During the confrontation, Gall made several profanity-laced and racially charged statements regarding Black teenagers at the party. She also made alarming comments about potentially shooting trespassers on the property. These statements were captured on body-worn camera footage from the responding police officers.
Following the incident, the Commission conducted an investigation, reviewing evidence including body camera footage. In her response to the complaint, Gall defended her actions, citing her role as a wife and mother who had witnessed her husband and son being attacked. She also mentioned experiencing “extreme emotional distress” related to a past assault.
After a thorough investigation, the Commission determined on July 17 that Gall should be removed from her position. Gall received the ruling on July 17, 2023, and has 30 days to request a full review from the state Court of Appeals.
As of the time of the report, Gall is typically suspended with pay following such a determination. Her annual salary as a Supreme Court Justice is $232,600.
